Terms of service

Effective 18 October 2026 · Last updated 23 October 2026

The short version: coaches pay for the plan they choose and can cancel any time; coaches are responsible for their clients' data and their coaching advice; we keep Spotter secure and don't sell anyone's data. The full terms are below.

1. Who we are and what these terms cover

Spotter (spotter.lk) is operated by Nexuf Tech LLC, a Wyoming limited liability company, registered at 30 N Gould St Ste R, Sheridan, WY 82801, United States (Wyoming Secretary of State filing ID 2026-001911073). "We", "us" and "Spotter" mean Nexuf Tech LLC.

These terms apply to everyone who uses Spotter: coaches (personal trainers who run a workspace and a public coach page), clients (people a coach invites to the client portal) and visitors (anyone browsing coach pages or Find a coach). By creating an account or using Spotter you agree to them. If you use Spotter for a business, you agree on behalf of that business.

Also part of these terms: our privacy policy, acceptable use policy, refund and cancellation policy and, for coaches, the data processing terms.

2. Accounts

You need an account to coach or to use the client portal. Sign-in is provided by our authentication partner, Clerk. Give accurate details, keep your password safe and tell us straight away if you think someone else has access. You're responsible for what happens under your account.

You must be at least 16 to create an account. Clients under 18 may use Spotter only with the consent of a parent or guardian (see the privacy policy).

One login works across coaches: a client who trains with two coaches has one account and a separate record with each coach. Each coach sees only their own records.

3. Coaches: your clients and their data

When you add clients and record their details (profile, sessions, payments, body measurements, progress photos, meal photos, plans and notes), you decide what to collect and why. You are the controller of that data and we process it for you under the data processing terms. You agree to:

  • tell your clients you use Spotter and point them to our privacy policy, and have a lawful basis for what you record;
  • get each client's explicit consent before recording health data such as body measurements, progress photos and meal photos, and a parent or guardian's consent for clients under 18;
  • get a client's written consent before publishing their before/after photos, name or review on your public page, and remove them when asked;
  • only invite people who expect to hear from you, and keep records accurate;
  • handle your clients' requests to see, correct or delete their data (we'll help, see the DPA).

4. Health and fitness disclaimer

Spotter is software for organising coaching. It is not medical advice and we don't check or endorse any workout, meal plan or advice a coach gives. Coaches are independent and are solely responsible for their advice, qualifications, insurance and the safety of their sessions.

Clients: talk to a doctor before starting a new exercise or diet programme, especially if you have a medical condition, are pregnant or take medication. Stop and get help if you feel pain, dizziness or shortness of breath.

5. Coaches and clients deal directly

Coaching agreements, session bookings, prices and payments for coaching are between the coach and the client. Spotter does not process those payments; amounts recorded in Spotter are a coach's own records. We are not a party to that relationship and are not responsible for refunds, no-shows or disputes between coaches and clients.

6. Acceptable use

Don't misuse Spotter. Our acceptable use policy lists what isn't allowed (for example scraping coach contact details, uploading content you don't have rights to, or trying to access another coach's data). We may remove content or suspend accounts that break it.

7. Plans, trials and payment

Coaches can use Spotter on these plans (prices in Sri Lankan rupees):

  • Free: up to 3 clients, no charge.
  • Pro: LKR 4,900 a month or LKR 49,000 a year, up to 12 clients.
  • Elite: LKR 9,900 a month or LKR 99,000 a year, unlimited clients and a featured listing.

The current features of each plan are shown on the pricing page. Prices may include or exclude taxes as shown at checkout; your card issuer may charge foreign transaction fees.

Trial. New coaches get a 30-day Pro trial. No card is needed and you aren't charged. When the trial ends, your workspace moves to Free unless you choose a paid plan.

Auto-renewal. Paid plans renew automatically at the end of each monthly or yearly period and are charged to your payment method through our payment processor, Stripe, until you cancel. We don't see or store your full card number.

Failed payments. If a renewal fails, you keep paid features for 7 days while Stripe retries. If it still fails, your workspace moves to Free. Nothing is deleted at that point, but Free limits and history rules then apply.

Price changes. We'll give at least 30 days' notice by email or in the app before a price increase takes effect. It applies from your next renewal after the notice period. If you don't agree, cancel before then.

8. Cancellation and refunds

Cancel any time from Billing in your workspace (Stripe Customer Portal). Cancellation takes effect at the end of the period you've paid for, and you keep paid features until then. Refunds follow our refund and cancellation policy.

9. Training on your own and Spotter Plus

You can use Spotter without a coach in your own private training space. Spotter Plus is an optional consumer subscription (USD 4.99 a month, or the local price shown in your store) bought in the Spotter mobile app through the App Store or Google Play. Apple or Google take the payment and renew it automatically until you turn off renewal in your store account at least 24 hours before the period ends. Cancellation keeps Plus until the end of the paid period. Refunds are handled by Apple or Google (see the refund policy). Apple and Google are not responsible for Spotter or its support.

If you are an active client of a coach on Pro or Elite (including a trial), Plus features are included free while that lasts. Free accounts keep 6 months of workout history in the training space; Plus keeps all of it. AI plans and answers are general fitness guidance, not medical advice.

If you join a coach you choose whether to copy your past workouts and measurements to them. Your coach only sees what's in their workspace.

10. History limits and your data

Each plan keeps a window of history visible: Free 6 months, Pro 2 years, Elite 5 years. Older records are hidden and then permanently deleted one year after they were hidden. Upgrading within that year brings hidden records back. Details are in the privacy policy.

11. Your content and the licence you give us

You keep ownership of what you upload: photos, videos, plans, reviews, notes and other content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and adapt (for example resize) that content only to run and improve Spotter for you.

For a published coach page, this licence also lets us show the page's content publicly, in Find a coach and in previews when the page is shared, until you unpublish or remove it. You confirm you have the rights and consents needed for everything you publish.

12. Our intellectual property

Spotter, its software, design and brand belong to Nexuf Tech LLC. We give you a limited, non-transferable right to use Spotter under these terms. Don't copy, resell, reverse engineer or build a competing product from it. If you send us feedback, we may use it without owing you anything.

13. Suspension and termination

You can stop using Spotter at any time. Coaches can cancel a paid plan as above and ask us to delete the workspace.

We may suspend or close an account if it breaks these terms or the acceptable use policy, if needed to protect other users or comply with the law, or for non-payment beyond the grace period. Where reasonable we'll warn you first and give you a chance to fix the problem.

Data export. Before or within 30 days after an account closes, a coach can ask us for an export of their workspace data (CSV or JSON). After that we may delete it as described in the privacy policy.

14. Availability and changes to Spotter

We work to keep Spotter running and secure, but it's provided "as is" and "as available". We may change, add or remove features. If we remove something material from a paid plan, we'll tell you in advance.

15. Limitation of liability

To the extent the law allows, we aren't liable for indirect or consequential losses (such as lost profits, revenue or goodwill), for injuries or losses arising from coaching, workouts or diet advice, or for disputes between coaches and clients.

Our total liability for any claim relating to Spotter is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you paid nothing.

Nothing in these terms limits liability that can't be limited by law, or rights you have under consumer protection laws where you live.

16. Indemnity

If you're a coach, you'll cover our reasonable costs from claims by your clients or others that arise from your coaching, your content, or your breach of these terms or of data protection law.

17. Governing law

These terms are governed by the laws of the State of Wyoming, United States, and disputes go to the state and federal courts located in Wyoming, United States. This doesn't take away mandatory consumer or data protection rights you have where you live, such as under Sri Lanka's Personal Data Protection Act No. 9 of 2022, or your right to bring a claim in your local courts where the law allows.

18. Changes to these terms

We may update these terms. For material changes we'll give at least 30 days' notice by email or in the app. Continuing to use Spotter after a change takes effect means you accept it. The date at the top shows the latest version.

19. Contact
